These Terms of Service ("Terms") apply to your use of the Curebrook website at curebrook.com and to any purchase you make from us. "Curebrook," "we," "us," and "our" refer to Curebrook LLC, a Florida limited liability company. "You" refers to anyone who visits the site or places an order. By using the site or placing an order, you agree to these Terms, our Privacy Policy, Shipping Policy, and Return and Refund Policy. If you don't agree, please don't use the site.
1. Who can buy from us
You must be at least 18 years old and able to enter into a binding contract to place an order. If you order on behalf of a practice, clinic, or other business, you confirm that you're authorized to act for it.
2. Professional-only products
Some products are marked as available only to licensed healthcare professionals or practices. To buy them, you must complete our professional verification and provide accurate license or practice information. By ordering these products, you confirm that you are a licensed professional (or are purchasing for one) and will use them only within the scope of that license. Orders that contain professional-only products are held until verification is complete. If we can't verify your status, we may cancel those items and refund you. We may ask for updated documentation at any time.
3. Product information and intended use
We try to describe products accurately, using information provided by the manufacturers. Product images may differ slightly from the actual item, and manufacturers may change packaging or specifications without notice. Always read and follow the manufacturer's labeling, instructions for use, and safety data sheets.
Content on this site is for general information only and is not medical, dental, or clinical advice. Products should be selected and used by trained professionals using their own clinical judgment, and in line with applicable laws, regulations, and standards of care.
4. Pricing and availability
Prices are listed in U.S. dollars and may change at any time without notice. Products are subject to availability. Despite our efforts, an item may occasionally be listed at an incorrect price or with incorrect information. If we find an error, we may cancel any order for that item, even after it's been confirmed or charged, and refund you in full. We may also limit quantities or refuse any order at our discretion, including orders that appear to be placed by resellers.
5. Orders and payment
Your order confirmation email confirms that we received your order; it isn't an acceptance of it. We accept your order when we ship it. You agree to provide current, complete, and accurate purchase and account information, and you authorize us to charge your payment method for the order total, including shipping and applicable taxes.
6. Tax-exempt purchases
If you claim a sales tax exemption, you must provide a valid exemption certificate before ordering. You're responsible for any tax, penalties, or interest that result from an invalid or improperly claimed exemption.
7. Shipping, returns, and refunds
Shipping is governed by our Shipping Policy, and returns and refunds by our Return and Refund Policy. Title to and risk of loss for products pass to you when we hand them to the carrier.
8. Warranties
Products may be covered by the manufacturer's warranty, and we'll help you make a claim where one applies. Apart from any manufacturer warranty and any warranty required by law, products are sold "as is," and we disclaim all other warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent the law allows.
9. Limitation of liability
To the fullest extent the law allows, Curebrook and its owners, employees, and partners are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of the site or any product, including damages arising from how a product is used. Our total liability for any claim relating to a product or order is limited to the amount you paid for that product or order. Some jurisdictions don't allow certain limitations, so some of these may not apply to you.
10. Indemnification
You agree to defend, indemnify, and hold harmless Curebrook and its owners, employees, and partners from any claims, losses, or expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your violation of any law, or your use or misuse of any product, including use outside the scope of a professional license or contrary to the manufacturer's instructions.
11. Accounts
You're responsible for keeping your account login secure and for all activity under your account. Let us know right away if you suspect unauthorized use. We may suspend or close accounts that violate these Terms.
12. Acceptable use
You agree not to use the site for any unlawful purpose; to misrepresent your identity or professional status; to interfere with the site's security or operation; or to scrape, copy, or resell site content or products without our written permission.
13. Intellectual property
The Curebrook name, logo, and site content we create belong to us. Product names, logos, and images belong to their respective manufacturers and are used to identify their products. You may not use any of this content without permission.
14. Third-party services and links
The site is hosted by Shopify and may link to third-party websites or tools. We're not responsible for third-party content, products, or practices, and your use of them is at your own risk and subject to their terms.
15. Governing law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or your purchases will be resolved exclusively in the state or federal courts located in Broward County, Florida, and you consent to their jurisdiction.
16. Changes to these Terms
We may update these Terms from time to time. The version posted on this page, with the "Last updated" date, applies to your use of the site and to orders placed after that date.
17. Other terms
If any part of these Terms is found unenforceable, the rest stays in effect. If we don't enforce a provision, that doesn't waive our right to enforce it later. These Terms and the policies referenced above are the entire agreement between you and us about your use of the site.
